  • Does your child with a disability have behaviors?
  • Has your child’s school contacted you to pick them up early due to behavior?
  • Has your child been removed from the general education classroom to an alternate location during the school day?
  • Has your child been removed from the bus with transportation as an IEP service?

These types of removals are often considered informal removals. They can count as a day of removal from the student’s placement, unless the removals are allowed in the student’s IEP.

The school must provide services to the student on the 11th day of removal in the school year (and any following days of removal). Additionally, if the removals add up to more than 10 cumulative days, and the removals are for substantially similar behavior, the school often must convene a manifestation determination case conference meeting to review the behavior.

If your child with a disability is being removed due to behavior, be sure to document the removals. Clarify why the student is being sent home early. Document the staff member you spoke with, what they said, and the date and time of the removal. Consider requesting a case conference meeting to discuss changes to your child’s behavior plan. Reach out to Ability Allies if you have questions or concerns.
